If You Answered "Yes" to either of these questions, then the LEGAL
AID SOCIETY OF SAN DIEGO, INC. can help!
The Clinic helps Taxpayers with federal individual income tax matters. Normally,
we do not assist with California state income tax matters.
Some of the kinds of federal tax matters that the Clinic handles includes
but is not limited to:
- IRS Audits
- IRS Collection Notices
- IRS Liens and Garnishments
- IRS Demands to File Tax Returns for Past Years
The Legal Aid Society will be providing free legal help at a special
tax clinic. Legal Services are available to persons who meet the Legal Aid Society's
low-income criteria.

These free clinics are open to members of the public who need assistance filing
a Civil Temporary Restraining Order. Additionally, those individuals who qualify
to receive our services will meet with a Legal Aid representative, during clinic
hours who will help them fill out the appropriate paperwork.

GENERAL INFORMATION ON
TEMPORARY
CIVIL RESTRAINING ORDERS
- The use of a temporary Civil Restraining Order is appropriate if (1) there
is no romantic relationship between the parties and (2) no close familial relationship
between the parties. If there has been a romantic relationship between the parties,
the appropriate court to bring a restraining order in is family court and one
can go to the Madge Bradley building located at 1409 Fourth Avenue, San Diego,
CA 92101 to get assistance with an order against such a person. If the person
is related to you (i.e. parent/grandparent/child/grandchild/ sister/brother/in-laws)
the restraining order should also be brought in family court.
- If you are over the age of 65, or if you are disabled, you may consider filing
an Elder Abuse Order. To obtain this order, please go to the Madge Bradley building.
This order has the option of a residence Exclusion Order, meaning that you may
kick out the individual from your home if he/she lives with you.
- The general standards for Civil Temporary Restraining Orders are: (1) Violence,
and/or (2) Threat of Violence, and/or (3) Continual Course of Conduct
causing a person to be emotionally distressed which serves no legitimate purpose.
- In general, there are no move-out or kick-out orders
with Civil TROs. That means if the order is against a roommate, you will not be
able to evict or get them removed from the home with this kind of order.
- The filing fee for a Temporary Civil Restraining Order is $303.50. Your fees
may be waived by the Judge if there has been violence or a threat of violence.
You may also file an application for waiver of fees with the court if you are
unable to pay the fees and are low income.
- Generally, your petition for a Temporary Order can be heard the same day you
file the order. At the Hall of Justice and at the South County Courthouse, TROs
are heard Ex-parte (emergency hearing) at 1:30 pm daily, and you must file by
1:00 pm to make sure your petition will be heard at that time. In the South County,
the TRO ex-parte is also heard at 1:30 pm. In the East County, ex-parte hearings
are heard daily from 9:00-11:00 am and 1:30-3:00 pm.

assistance filing a Domestic Violence Temporary Restraining Order. Additionally,
those individuals who qualify to receive our services will meet with a Legal Aid
representative, during clinic hours who will help them fill out the appropriate
paperwork.

are NOT representing you at trial!
You may apply for a Domestic Violence Restraining Order if you have been
the victim of any of the following:
- Actual physical violence
- Stalking
- Sexual Abuse
- A serious threat of physical violence
- Harassing and annoying phone calls
- Destruction of personal property
AND
You have one of the following relationships with the party to be restrained:
- You are married or were formerly married to the other party
- You have or formerly had an engagement or dating relationship with the other
party
- You and the other party have a child or children together
- You are related to the other party by blood, marriage or adoption
- You and the other party are living together, or formerly lived together, as
members of a household.
To apply for a Domestic Violence Restraining Order, ask the Family Law Clerk
for a DOMESTIC VIOLENCE RESTRAINING ORDER packet. If you do not have one of the
above defined relationships with the other party, you may consider asking the
Civil Clerk for a CIVIL HARASSMENT RESTRAINING ORDER packet.
**** There is no fee to file a Domestic Violence Restraining Order. Your
petition will be heard by the Judge the same day you file, but it must be filed
by 4pm.

Free Legal Clinics
The San Diego County Public Law Library
(SDCPLL) is pleased to announce a continuing partnership with the University of
San Diego (USD) School of Law for the Fall 2008 semester. The
Library will host a free walk-in legal clinic supervised and staffed by USD Law
School faculty, which has a tradition of working with San Diego residents
in need of legal services.
The
clinics will provide assistance on most civil matters, excluding family law. The
clinic cannot provide assistance in criminal or bankruptcy cases.

who have previously signed up for the clinics must confirm their reservation
in person 30 minutes before the start of their assigned time.
Those who have checked in on time
will be seen on a first come, first served basis.

Joslyn Senior Center
Free Legal Clinics
The Joslyn Senior
Center in Escondido offers a free legal clinic from 9-11 a.m. on Wednesdays
for:
- seniors (55+ years of age,
- disabled,
- low income*, and
- minorities.
Participants do not have to be residents of Escondido. An appointment is mandatory
and can be made by calling (760) 480-0611. Volunteer attorneys spend about 15
minutes with each participant and help them with civil matters, such as reviewing
wills or divorce. The Joslyn Senior Center schedules clinics up to two weeks in
advance. Sponsored by The Senior Service Council, Escondido (SSCE).
* income must be below federal poverty guidelines: $8980/a
single person, $18,400/a family of four, information based on 2003 federal poverty
guidelines. Contact the Joslyn Senior Center to verify eligibility.

Del Mar Community Connections
Legal Clinic for Seniors
The Del Mar Community Connections' Legal
Center provides legal services by appointment once a month on the last Friday
of every month from 1- 5 p.m. Appointments are about half hour each, and in
order to schedule an appointment to see an attorney, you must be:
- a resident of the City of Del Mar, and
- over 60 years of age.
You MUST CALL (858) 792-7565 for an appointment, and attorneys can advise
you on legal issues such as consumer problems, age discrimination, fraud, abuse
and neglect, landlord / tenant issues, some family legal issues, social security
and public benefit problems, wills, and powers of attorney for health matters.
